Order

An Order shall be subject to the following provisions: The Photographer shall be entitled to require a booking fee payment from the Client prior to the taking of any steps to create any Material. In the event of a cancellation of an Order by the Client, in addition to any entitlement to claim damages for losses arising from such cancellation the Photographer shall, in any event, be entitled to retain the deposit paid and/or agreed. Unless specifically otherwise agreed in writing between the Photographer and the Client, the Photographer is entitled to utilise Material ordered by the Client for the advertising, marketing and promotion of the Photographer's business. Any work of any description undertaken by the Photographer pursuant to an Order shall be subject to these Terms and Conditions. In consideration of the Price the Photographer will undertake such work as is necessary to fulfil the requirements of an Order.

Session appointment

Only immediate Family members during each session. Studio sessions are taking place at my cosy home base studio in Willenhall (Wolverhampton). Outdoor sessions taking place in Wolverhmapton and Walsall area.

Sickness & Cancellations

We understand that children can be unpredictable and can fall ill at any time. In the event of sickness prior to the session, Client agrees to make every possible effort to inform Kidi Photography no later than 72 hours prior to the start time of the photography session. The session can be transferred to a new date which will be at the convenience of both parties within a maximum 1 month period. Please, not we do not refund any session fees paid towards photo sessions.

When You book a newborn session with Kidi Photography, a session slot will be reserved around your baby’s due date. However, should your baby arrive much earlier or past their due date, there will be first available slot offered with no guarantee of a weekend appointment.

No-shows will be treated as a cancellation and in such event session fee paid towards the reservation will be considered lost. In addition, we do not offer session transfers. This means once a newborn session has been reserved, the fee paid towards the reservation can not be transferred towards any other photo session.

Session can be rescheduled (given 72 hours notice) only once, after that session fee will be considered lost. Booking fee is not transferable on a different kind of the session booked previosly and maximum time perios new date must be booked is 3 weeks. If Client wouldn't reshedule a session in max 3 weeks time, then booking fee will be considered lost. If Client doesn't show on the session witout notice, then booking fee will be considered lost. Session can be reshedule max 2 times in period of 3 weeks time from first session date booked in.

Sickness – once the session starts it cannot be rescheduled to another date/time. Also, please keep in mind that we insist on keeping our studio environment hygienic and sickness free as possible to assure our Clients (and little models in particular) are not exposed to any viruses or other pathogens. Please, do not attend the studio with a sick/unwell child. If at any point Photographer notices that the child or yourself are unwell your session will be immediately ended and your session fee will be considered lost.

Session fee (non-refundable) is required upfront towards securing your slot. Remaining balance is payable on the day of your session. Additional images are prepared after the payment has cleared. We do not hold responsibility for delays caused by late payments.

Session fee covers your appointment reservation only. There are no digital images or other products included in the fee. Please, assure you are fully aware of product prices and packages, prior to booking your appointment. All information is available on the website as well as via email upon request.

In addition, should you come late to your appointment the photographer will allow 25 minutes to wait for your arrival. Time spent awaiting your arrival will be taken of your session's time meaning your session time will be significantly restricted and may result in reduced number of photographs in your final gallery. If you come to your appointment more than 25 minutes late, due to the restricted time frame your session will be unfortunately cancelled and session fee paid towards securing your slot will be considered lost.

Specific requirements

Please note, any specific requirements for props and prefered colour palette should be discussed when booking your session. If you have any color preferences, backdrops you want to be used or props, please let me know not later then 72h before the session.

I always prepare to each session individually, and making your preferences and expectations clear beforehand, is an important part of the process. I would also like to stress, that all photographs will be prepared with accordance to my portfolio. Choosing me as your photographer is therefore tantamount to accepting my original style and aesthetic.I put a lot of effort into planning each session, and I always approach my clients individually. I am more than happy to incorporate parents' inspirations and accommodate specific requests, so long as they appreciate and reflect my style.

Safety

You agree to hold harmless, Kidi Photography by Ella and representatives from any dispute in the event you become injured or ill during your session or while on the studio premises. Kidi Photography by Ella and its representatives will not be held liable for any injury, illness or death incurred by you or your family (including illness to COVID-19), or any damage to your property during the photo session or while on studio premises.

Our safety is important, so please leave your shoes outside the studio. Only immediate Family members during the session.

Payments

Booking fee (non-refundable) is required upfront towards securing your slot. Remaining balance is payable on the day of your session. Additional images are prepared after the payment has cleared. We do not hold responsibility for delays caused by late payments. Booking fee is included in a total price of your package but it do not cover a session time. Booking fee do not include any photos or products.

Prices include a £50 discount for allowing the photographer to use images from the session for publicity and advertising purposes. If the Client wishes for the photographs not to be used by the photographer on social media or for this purpose, the discount won't apply. This need to be communicated strictly before the session takes place.

Weekend spaces available for an extra fee (on the top of the package).

COVID- 19 updates. If your session will be booked in during lock down, do not worry about your non- refundable booking fee. In this situation you will be able to use it on any photo session with us in next 6 months period without any loss.

Image reproduction

Owing to photochromatic anomalies caused by a combination of certain dyes and materials, especially in man-made fibres, it is sometimes impossible to record on camera the exact color of materials as perceived by the human eye. When processing images, the photographer will endeavour to achieve a pleasing overall colour balance based on natural flesh tones. It is understood that some colours may not remain consistent throughout a set of photographs owing to variations in lighting conditions. It is also understood that all photographic printing is undertaken within the technical limitations of the process and that colour may not be identical over the whole range within a subject. The colour balance of prints made at different times or in varying sizes may also be variable. Due to the limitations of computer monitors it is understood that images may appear differently according to the specification of each monitor and that prints will not match images rendered on any particular computer monitor. All print and presentation sizes quoted are approximate and subject to the discretion of the photographer.

Editing process takes 3-6 weeks depends from the time of the year and how busy we currently are. Hovewer there is an option for a fast editing service in a 5 working days from the session day for a £50 fee. If you are interest in fast editing option please contact with us before the session to make sure we have availability for it as we have limited numbers of spaces for fast editing each month.

The editing of photos does not include actions such as swapping heads in photos, changing the colors of clothing, enhancing makeup, etc. Such interventions can be made with an additional fee of £30 per each individual image, charged prior to editing. Editing services encompass light skin smoothing, general color correction, wrinkle reduction, and slight body slimming where applicable.

Storage of digital photos

Kidi Photography reserves the right to delete online galleries and any images stored after a period of 6 weeks from the date of informing Clients that their gallery is ready to collect.

After receiving purchased images Kidi Photography will not be held responsible for storing Clients’ image files. In addition, it is Clients’ responsibility to check the images on the USB provided for any faults or missing images. If the USB is faulty on the same day as collection Kidi Photography will replace it at no extra cost (free collection and postage fee need to be paid if Client want it to besend to the home address). It there are any prblems with USB later then 24h then all the chosen photos will be send via Drop Box to download (link available for 48h). Please, make sure that you create multiple copies of your digital images on your computer, cloud or any other suitable (secure) storage. Kidi Photography by Ella is keeping images for 6 weeks. After this time Photographer may not have photographs from the session.

Print's quality

When printing your photos please note Kidi Photography can not be held responsible for poor quality prints from printing shops or online printers. Kidi Photography can provide you with high quality professional prints, please contact us to discuss further details.

Repeated sitting

Dear parents, I'd like to urge you, if your children are very lively and find it difficult to sit still or don't like having photos taken of them, please do not force them to come to the photo session. From my experience, it is usually a waste of time for both, me as a photographer and the parents.

Please keep in mind, that my job as a photographer is to capture portraits and this is my main focus during each photo session. Repeated sitting is only offered when due to unforeseen circumstances, within my responsibility I am unable to provide a full gallery (i.e. equipment failure etc.).

Moreover I would like to point out that I can not be held responsible for delays in gallery preparation caused by equipment failure or client's delayed selection from an on-line gallery. Editing and retouching takes roughly two weeks from the moment I receive selected images.

Responsibility of any damages

You agree to hold harmless, Kidi Photography and its representatives from any dispute in the event of becoming injured during your session and/or while on studio premises. Kidi Photography and its representatives will not be held liable for any injury incurred by you or your family (including third party), or any damage to your property during the photo session or while on studio premises. Clients will be expected to take responsibility of any damages caused by themselves or their children during their photo session or while on studio premises and may be charged to replace props/items that belong to Kidi Photography.

All images taken at your session are copyrighted by Kidi Photography by Ella and are protected by Copyright Law. It is therefore unlawful to reproduce their work in any manner without written permission from Kidi Photography by Ella. Reproduction includes, but is not limited to, scanning, downloading, right-clicking, saving to hard drive, posting on websites or blogs without giving full credit to the photographer, photocopying, printing screen shots, or printing images in any manner without obtaining print release written by the Photographer. Please respect Kidi Photography's livelihood and the care and attention paid to each and every one of your images by adhering to copyright laws. Kidi Photography by Ella wishes to have artistic control over the final look of the client's images. Scanned or reproduced images are both illegal and a degradation of the original image quality. You buy photos to personal use only! It is against copyright law to amend , change , re-edit Images in any shape or form.

In addition, the photographer reserves the right to be the sole editor of the images. The client nor anyone else hired by the client is permitted to retouch and/or modify the photographs in any way without permission provided in writing. This includes applying filters, conversion of images from colour to black & whit, and any other form of editing. Please not, photographer do not remove/fix make up, tatoos, earbrowns, ect.

On-line gallery and image sellection

After your session, an online gallery of up to 20 unedited images will be provided for you to select your preferred photos. Once your selection is made, the chosen images will be professionally edited.

For the highest packages, there is no option for image selection as all photos are included in your package as stated in the pricing information.

Editing begins only after the Client has made their selection and any outstanding balances are cleared.

Awaiting time for prints is 2-3 weeks, canvases 3-4 weeks. Any other wall arts 3-5 weeks. Please be aware that Kidi Photography by Ella do not take resposibility fr delays caused by courier damages or supplayer delays.

Newborn session - earlier/late baby arrival

In the event of an early arrival, we request to contact immediately (on the same day of baby's arrival) to reschedule the session. Similarly, if the baby is overdue more than 5 days, your session will be rescheduled to the earliest convenient slot. Please note, that this is Client responsibility to let us know in case of earlier/later arrival. If Client do not let us know minimum 5 days before the provisional session day thay baby is not here, then we wouldn't be able to reshedule the session and Client will lost the booking fee. We need minimum 5 days notice to be able to fell space with a new Client.

Set - ups for your session

If you want me to use some sets from my portfolio or you have any favorite colors you should let me know about this 10 working days before the session. If not I will prepare everything according to my unique style.

Display

The Client hereby allows the photographer to display any images covered by booking session to generally promote the business by means of advertising, publicity material, websites, social media and other such media. Should you wish to keep your gallery private, please make sure to contact the Photographer prior to booking your session.

Groups Photography

Please note, studio sessions are designed to serve photographing groups not larger than 5 members. For groups with more than 5 members we can arrange an open air photo session, or reserve a private venue of client’s choice (subject to additional fees).

Fine art photography - artistic vision of photographer

As you can see on the home page, I am an fine-art photography. It means that I am usuing specyfic style of lighting, posing and what is the most important- style of editing- My style is very specyfic so please make sure you check porfolio BEFORE you will book a session. This is part of my work (photographs) and a part of my soul. Something what will not be adjusted or amended to individual customer preferences.

All the photos from each session (standard and minis) are always edited according to my style.

Please, be aware that in fine art photography the main focus is placed on the creative vision of the artist, rather than solely depicting the models. In fine art photography, the photographer is the artist, and capturing the subject is not the main purpose. Making an artistic statement is. A fine art portrait image is created by the photographer as an artist and not just by the camera. The photographer’s vision is central to the resulting shot.

I also understand and respect that everyone has a different taste so I hardly believe it is importan to choose a Photographer who create photographs you love. I will be more than happy to work with you if you love my style.

Outdoor Photography - additional costs

Depending on your choice of locations, there are no additional costs involved when your preferred place is located within 10 miles from post code WV13. Places located over10 miles from WV13 will incur additional traveling expenses. For locations over 10 miles away from WV13, please contact the Photographer prior to booking your appointment. Locations used by a photographer are included in a package price.

Please note, for Open Air sessions, I am unable to provide a large range of props or outfits. Props for babies and toddlers are available upon request, as well as maternity dresses for pregnancy photo shoots. Clients wishing to include additional decorations in their photo session will be responsible for providing these for the shoot.

Due to travel logistics, outdoor sessions are booked on a grouped schedule, with multiple sessions planned on the same day. It is important to arrive on time for your session, as delays may lead to unavoidable consequences, such as reduced photo quality, fewer finalized images than specified in your package, less polished poses, or a rushed workflow. The Photographer cannot be held responsible for such outcomes resulting from client tardiness.

Additionally, following an unfortunate incident a few years ago where my camera was stolen during an outdoor session, I now book these sessions only on days when my husband is available to accompany me as a security measure. This ensures a safer and more comfortable environment for everyone involved.

Weekends appointments

We do not work weekends but weekends appointments are possible for an extra weekend fee of £50. Any other appointments are booked with £20 weekend fee.

Data protection

Data Protection - The data protection declaration of the Kidi Photography by Ella is based on the terms used by the European legislator for the adoption of the General Data Protection Regulation (GDPR). Kidi Photography by Ella will store Client names, contact details and session information privately and will not share these with any other businesses or organizations. You can find out more here.

Special offers

For all special offersmodeal release must be sign. Otherwise Client do not apply for any special ffers.

Clients are not permitted to take photos on their own during photo sessions! If you want to take any photos or videos by your own than you will be charge an extra fee of £200 on the top of the package.
