Understanding Copyright Laws and Your Rights as a Photographer


Over the past few months, I’ve received an increased number of questions from clients who are unfamiliar with what copyright means for photographers and why the images I deliver to you do not include copyright ownership. Copyright always remains with me as the creator of the work. I’ve decided to explain what copyright is, why any alterations to the images I provide are prohibited, and how these rights protect both my artistry and your memories.

What Are Copyright Laws?

In simple terms, copyright laws grant creators exclusive rights to their work. For photographers, this means the images we produce are legally our property. From the moment I click the shutter, I own the rights to the image, regardless of who or what is in the photograph. These laws ensure that my creative vision and efforts are protected, and any use of my work without permission could result in legal consequences.

Why Do the Copyrights Belong to Me as a Photographer?

Creating a photograph involves far more than just pressing a button on a camera. It’s a process that requires investment, expertise, and creativity:

  • Specialized Equipment: I use professional-grade cameras, lenses, lighting, props, backdrops and even location for an outdoor sessions

  • Artistic Vision: Every photo I take reflects my artistic style and years of experience. From positioning the subject to adjusting the lighting and selecting camera settings, each detail contributes to the final result.

  • Editing Skills: After the session, I spend hours editing images using advanced software to achieve the polished look you see in the final product. This step is as important as the photoshoot itself, turning raw captures into timeless art.


At every stage of this process, I am the creator, which legally makes me the copyright holder of the image. The law recognizes the creative input, time, and resources invested by the photographer, ensuring these rights remain with the artist unless explicitly transferred.

Common Misconceptions About Copyright

Some clients may wonder why they don’t own the copyright to their images, even if they appear in them. To clarify: hiring a photographer is like ordering a cake from a baker. While the cake may be made for you and reflect your preferences, you don’t automatically become the baker. Similarly, even though you might appear in the photo, the photographer—like the baker—retains ownership of the creation. Unless the copyright is explicitly sold (which involves a separate agreement and fee), the photographer—in this case, me—maintains all rights to the image.

What You Can and Cannot Do with My Images

When you purchase images from Kidi Photography by Ella, you’re buying the right to use those images for personal purposes. Here’s a breakdown:

Permitted Uses:

  • Printing your images for personal enjoyment, such as creating albums or wall art.

  • Sharing purchased digital images on personal social media accounts.

  • Storing images on multiple devices or cloud services for safekeeping.

Prohibited Actions:

  • Saving or screenshotting images from online galleries without purchasing them.

  • Cropping out my watermark or logo from any preview images.

  • Applying filters or additional edits to the images.

  • Using images for commercial purposes, such as on business websites or promotional materials, without obtaining a commercial license.

  • Making copies of prints or creating digital duplicates without permission.

Each of these restrictions exists to protect the time, effort, and artistic integrity that go into creating your images.

Why Respecting Copyright Matters

Respecting copyright isn’t just about adhering to legal requirements; it’s also about valuing the artist’s work. Imagine a scenario where someone takes credit for your hard-earned achievements—it’s not only disheartening but also unfair. By honoring copyright laws, you’re supporting small businesses like mine and ensuring photographers can continue creating beautiful memories for families.

Can Client Buy the Copyrights?

Yes, it is possible to purchase copyrights to your images. However, this involves a separate agreement and a fee that reflects the value of relinquishing those rights. This ensures fair compensation for the potential loss of future revenue or artistic control over the images.
